Mandatory Agreement: Before resuming classes, all Members must consent to a new Waiver, Release, and Compliance Agreement (attached).

Symptom Screening: Coaches and Members are prohibited from entering the facility or participating in any class if they exhibit any of the following symptoms:

Coach Requirements: Coaches must adhere to stringent health screening protocols, including the attached Waiver, Release, and Compliance Agreement. Before leaving home for a HIIT THE COURT class, coaches must self-assess for symptoms and remain home if any are present or if they have been in contact with a COVID-19 positive or suspected individual. Upon arrival at the facility, coaches must undergo another self-screening. Coaches exhibiting symptoms or feeling unwell are prohibited from entering or remaining at any HIIT THE COURT class or facility. In the event of a COVID-19 diagnosis, coaches cannot lead HIIT THE COURT classes and must follow all CDC, federal, state, and local guidelines.
Vaccination Mandate: All Coaches and Members must be fully vaccinated against COVID-19.

Waiver, Release, and Compliance Agreement

The HIIT THE COURT member (the “Member”) hereby acknowledges and agrees to the following:

HIIT THE COURT's Precautionary Measures: HIIT THE COURT LLC is implementing all necessary precautions to safeguard its Members, coaches, trainers, facility users, and the general public.
Member's Obligations: The Member agrees to strictly adhere to all rules, policies, guidelines, and recommendations issued by the Center for Disease Control, any relevant governmental authority (federal, state, and local), and HIIT THE COURT's policies and procedures for social distancing and COVID-19 prevention. This includes completing a mandatory self-health check before entering any HIIT THE COURT facility or class.
Health Declaration: By attending a HIIT THE COURT class, the Member confirms the following and agrees to refrain from attending any class or facility if unable to confirm any statement:

No fever or temperature of 99.9 degrees or higher within the past 48 hours.
No cough or breathing difficulties within the past 48 hours.
No loss of taste or smell within the past 48 hours.
No known "close contact" with a COVID-19 diagnosed individual. "Close contact" is defined as living with, being within 6 feet of, or having direct contact with secretions (e.g., shared utensils, being coughed on) from a COVID-19 positive person. Medical professionals treating COVID-19 patients are exempt from this clause.
No self-isolation or quarantine requests from a doctor, health official, or medical professional.
Fully vaccinated against COVID-19.

Compliance with Guidelines: The Member agrees to comply with all current and future HIIT THE COURT and HIIT THE COURT coach guidelines, directions, and policies related to COVID-19 prevention and general safety.
Assumption of Risk and Waiver of Liability: The Member acknowledges the inherent risks of participating in a HIIT THE COURT class during a global pandemic and waives all rights to claims arising from their participation, including claims related to contracting infectious diseases (e.g., COVID-19), personal injury, bodily injury, death, and property loss or damage, regardless of cause. This waiver extends to the Member's heirs, administrators, executors, successors, and assigns. The Member is also subject to HIIT THE COURT's general liability waiver, release, and acknowledgment of risk (available at https://www.hiitthecourt.com/terms-and-conditions), which may be updated from time to time. The Member further covenants not to sue or assert any claims against HIIT THE COURT or any other party for any liability arising out of their participation in any HIIT THE COURT class, even if the liability arises out of negligence or other causes. This waiver and release shall inure to the benefit of HIIT THE COURT, all of its officers, directors, members, owners, employees, coaches, and the owners of any facility where HIIT THE COURT operates.
